Abstract: The subject of AI models built upon litigation, judicial, and arbitral analytics is a complex topic requiring significant forethought and a sophisticated understanding of practical concerns any arbitrator, party, or attorney will likely encounter before addressing this research, as such this paper will seek to address those concerns in six sections: (II) background information and the history of artificial intelligence and litigation analytics, (III) ethical issues surrounding the use of AI and arbitral analytics, (IV) prior research on FINRA arbitration awards with a brief analysis of the results, (V) the application of the novel FINRA-BERT fine-tuned model on FINRA arbitration awards with a subsequent detailed review of prior sentiment analysis and this paper’s results, (V) a cursory overview of subsequent research for FINRA arbitral analytics and AI modeling, and (VII) a concise summary conclusion.
